THE OUTDOOR CHANNEL'S SPRING FEVER SWEEPSTAKES OFFICIAL RULES – NO PURCHASE NECESSARY TO ENTER OR WIN.
You may enter the Daily Drawing(s) and Grand Prize Drawing Sweepstakes by one of the available entry methods: (i) (a) visit The Outdoor Channel website http://www.outdoorchannel.com and follow the links to the Sweepstakes site http://springfever.outdoorchannel.com (the "Sweepstakes site"), (b) complete all required information on the online registration form and (c) click on the "Submit" button; or (ii) (a) visit The Outdoor Channel website http://www.outdoorchannel.com and follow the links to the “Spring Fever” Photo Contest site http://springfever.outdoorchannel.com (the "Contest site"), (b) complete all required information on the online registration form, (b) upload digital photograph related to “My Favorite Getaway”, (c) create a caption for your photo; and (d) click on the "Upload" button. Daily Entry Period: Between 12:00:00 AM ET on April 1, 2014 and 11:59:59 PM ET on April 29, 2014, each day an eligible participant enters the Sweepstakes, the participant can receive one (1) entry into that day's Daily Drawing via the Website and one (1) entry into the Grand Prize drawing. For purposes of this Sweepstakes, a "day" is defined as 12:00:00 AM ET through 11:59:59 PM ET (the "Daily Entry Period(s)"). Daily Entries must be received during a Daily Entry Period to be eligible for that Daily Drawing. Daily Entries will not be carried forward for subsequent Daily Drawings, if any. A participant can only earn one (1) entry into the Daily Drawing and one (1) entry into the Grand Prize Drawing per person/email address, per day, during a Daily Entry Period. If multiple entries are received during the same day, only the first Website entry will be accepted and additional entries will be disqualified. Grand Prize Bonus Entry Period: In addition to the Grand Prize entries received each time you enter during a Daily Entry Period, when you enter, beginning 12:00:00 AM ET on April 30, 2014 through 11:59:59 PM ET on April 30, 2014 ("Grand Prize Bonus Entry Period"), you will receive one (1) additional entry into the Grand Prize drawing. Limit one (1) Grand Prize entry per person/email address during the Grand Prize Bonus Entry Period. Spring Fever Photo Contest Bonus Entry Period: In addition to the Grand Prize entries received each time you enter during a Daily Entry Period, when you enter the Contest Site, beginning 12:00:00 AM ET on April 1, 2014 through 11:59:59 PM ET on April 30, 2014 ("Spring Fever Photo Contest Bonus Entry Period”), you will receive one (1) additional entry into the Grand Prize drawing. Limit one (1) Grand Prize entry per person/email address during the Spring Fever Photo Contest Bonus Entry Period. Therefore, you may receive up to thirty (31) Grand Prize entries total during the Sweepstakes Period. By entering the Sweepstakes, participants acknowledge that they are aware of and agree with the Sponsor's privacy policy located at: http://www.outdoorchannel.com/PrivacyPolicy.aspx. Sweepstakes, an entry is “received” when the Website’s servers record the entry information. Proof of sending (such as, without limitation, a printed, saved or copied automated receipt confirming entry, a “thanks for entering” screen or message) does not constitute proof of actual receipt of an entry for purposes of this Sweepstakes. Multiple participants are not permitted to share the same email address. Any attempt by any participant to obtain more than one (1) entry per day by using multiple/different email addresses, identities, registrations or logins, or any other methods may void that participant’s entries and that participant may be disqualified from the Sweepstakes. Entries generated by a script, macro, bot or any other automated means will be deemed void. Entries that are submitted through sweepstakes clubs or similar methods, or those that are mechanically reproduced, copied, incomplete, or inaccurate, are void. Subsequent entries submitted by the same person or the same email address, on the same day are void. ELIGIBILITY: The Outdoor Channel's Spring Fever Sweepstakes (the "Sweepstakes") is open only to legal residents of the U.S., who are twenty-one (21) years of age or older as of April 1, 2014. The Outdoor Channel, Inc. ("Sponsor"), K2 Marketing Group, Inc. ("Administrator"), Go RVing, Shell ROTELLA, BUSHNELL, Mossy Oak, and Primos (the "Sweepstakes Partner(s)") and each of their respective parents, affiliates, subsidiaries, advertising and Sweepstakes agencies, and each of their respective officers, directors, employees and members of the immediate family (the "Sweepstakes Entities") and persons living in the same household of each, are ineligible to enter the Sweepstakes. WINNER SELECTION/NOTIFICATION/VERIFICATION: Daily Winners will be selected in Daily Drawings conducted by Administrator on or about one (1) business day after each Daily Entry Period ends, from among all eligible entries received during that applicable Daily Entry Period. The number of Daily Prizes will be awarded according to the Daily Prize Chart set forth below. Daily Prize Winners will be notified by phone or email approximately two (2) weeks from the respective Daily Drawing if they are required to fill out an affidavit and/or Release, or if any further information is needed to fulfill their prize, or the Sweepstakes Entities may simply mail the Daily Prize Winner(s) their respective prize(s) to the address provided upon entry. Daily entries will not be carried over into subsequent Daily Drawings, if any. There will be one (1) Grand Prize Winner selected in the Grand Prize Drawing conducted by Administrator from among all eligible Grand Prize entries received during the Sweepstakes Period. Administrator, an independent judging organization, whose decisions are final on all matters relating to this Sweepstakes, will conduct the Grand Prize Drawing on or about May 2, 2014. The potential Grand Prize winner will be notified by phone or email on or about May 4, 2014. As a condition of winning any prize herein, all Prize Winners (Daily and Grand) of prizes valued at $600 or more will be required to sign and return, within five (5) calendar days of notification attempt (or less if a time is specified by Sponsor during notification or on the Release) an Affidavit of Acceptance, Eligibility, Publicity (where legal) and Liability Release ("Release"), and a W-9 form for tax purposes. Winners are responsible for all federal, state and local taxes (if any). Such Daily and Grand Prize Winners of prizes valued at $600 or more will be issued an IRS 1099 tax form for the actual value of their prizes at the end of the year. By entering, all entrants and winners hereby consent to the use by the Sweepstakes Entities of their entry and all information contained therein, including but not limited to, name, likeness, image, statements and/or other indicia of persona, and personally identifiable information (collectively "Likeness"), for any and all uses and purposes in any media now known or hereinafter developed throughout the world (including the World Wide Web) without additional consideration (where legal), consent or prior review, and upon request will provide written consent to such use. Noncompliance, failure to return any documents within the time specified, failure to respond to notification attempts or returns of any prize/prize notification as undeliverable will result in disqualification and an alternate potential winner may be selected. Total Approximate Retail Value ("ARV") of all prizes given away in this Sweepstakes is Forty-three Thousand Nine Hundred Seventy dollars ($43,970.00). Odds of winning the Grand Prize depend on total number of eligible entries in the Grand Prize Drawing. Odds of winning a Daily Prize depend on total number of eligible entries received during that applicable Daily Entry Period. There is a limit of one (1) Daily Prize per person/email address, per day, however, a winner of a Daily Prize is still eligible to win the Grand Prize. In no event will Sponsor be responsible for awarding more than the herein stated number of prizes. Actual value of any prize may vary depending on fluctuations and on current market conditions at time of prize fulfillment, and any difference between the stated ARV and the actual value, if any, will not be awarded. Prize conditions may be added or modified by companies providing those portions of the prize. The prize restrictions/conditions stated herein are not all-inclusive. All prize packs and/or prize bundles will consist of Sweepstakes Partner products awarded entirely in the Sweepstakes Entities discretion, and the Sweepstakes Entities hereby reserve the right to substitute the items shown on the prizes page and/or those listed in these Official Rules with items of similar value. The winner of the Grand Prize must have the appropriate license to operate such vehicle (if any is needed) and is solely responsible for title/license/registration/dealer prep/insurance/taxes and any other similar costs (if any) associated with this prize that is not included in the prize description, at Sponsor's discretion. Such prize will be delivered to a dealership near to winner's residence (in Sponsor's sole discretion) and winner must take delivery of camper or trailer within sixty (60) days of notification that the dealership has received the camper or trailer, or else such prize may be forfeited. Manufacturer's warranties apply. Actual camper or trailer to be provided as Grand Prize (including, but not limited to, color, options, and accessories) will be determined by the Sweepstakes Entities, in their sole discretion, based on availability at the time of fulfillment. Winner must have proof of any valid insurance required for ownership of such camper or trailer in order to receive prize or else prize may be forfeited. The winner(s) of any weapon related prizes will be arranged for and awarded only in compliance with federal and state laws and applicable local ordinances. If a winner of any such prize is ineligible to receive such a prize under relevant state, federal or local laws and regulations, such prize will be forfeited and no substitution will be provided. No transfer, substitution, or cash equivalent for any prizes in whole or in part will be permitted, except at Sponsor's sole discretion due to prize unavailability for any reason, and only then for a prize of greater or equal value determined by Sponsor shall be allowed. All prize details are at Sponsor's sole discretion. Prizes are awarded from Sponsor "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. However, any and all guarantees and warrantees on merchandise prizes may remain subject to the manufacturer's terms and conditions, and winners agree to look solely to said manufacturers for any such warranty or guarantee claim. All prize details are in Sponsor's sole discretion. DISPUTES/GENERAL: The Sweepstakes is governed by the laws of the State of California, with venue and jurisdiction in Riverside County, CA and all claims must be resolved individually, without resort to class action, in the courts located in Riverside County, CA. By entering, entrants/winners agree: (1) to release and hold harmless the Sweepstakes Entities and their agents from any and all alleged or actual claims, actions, injury, liability, loss or damage of any kind, including but not limited to, personal injury, bodily injury, or death, resulting from participating in this Sweepstakes or from the acceptance, possession, or use or misuse of any prize awarded or participation in any prize-related activity; (2) to be bound by these Official Rules; (3) that the decision of the Sponsor and Administrator is final and binding on all matters relating to the Sweepstakes; and (4) to the use of their Likeness in any and all media now known or hereinafter developed, worldwide (including online) without additional compensation, except in TN and where otherwise prohibited by law. Winners are responsible for all federal, state and local taxes. Sweepstakes Entities are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Sweepstakes which may limit the ability to participate or by any human or technical error which may occur in the processing of the entries in this Sweepstakes. Persons found tampering with or abusing any aspect of this Sweepstakes, as solely determined by Sponsor, will be disqualified and may be subject to prosecution. If in the judgment of Sponsor, the Sweepstakes is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, which corrupts the administration, security, fairness or proper play of the Sweepstakes, Sponsor reserves the right, in its sole discretion to discontinue, modify, suspend or terminate the Sweepstakes and award the applicable prizes if reasonably commercially feasible in random drawings from among eligible applicable entries received as of such date. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. As permitted by law, and in accordance with the Sponsor's Privacy Policy, Sponsor and/or partners (where applicable) may use information, which all entrants provide about themselves, to send them announcements about the Sponsor's products and programs via electronic and ordinary mail if so opted in. An entry, except where prohibited by law, constitutes a grant of permission to the Sponsor or its agents to include winners' names on the Sweepstakes Site and on http://www.outdoorchannel.com and in connection with a Winners List without further notice or without additional compensation. UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANTS HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, CONSEQUENTIAL, OR ANY OTHER DAMAGES WHATSOEVER. IN NO EVENT SHALL SPONSOR BE LIABLE TO ANY ENTRANT OR WINNER FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZE TO BE AWARDED TO THE INDIVIDUAL ENTRANT IN THIS SWEEPSTAKES.
